Fimakron Platform (hereinafter "Service") is an online service provided by Fimakron Oy (hereinafter "Fimakron") comprising investment analysis, prediction competition and administration applications, available at fimakron.net.
By using the Service, the user (hereinafter "User") accepts these terms in full. If the User does not accept these terms, they must refrain from using the Service.
Fimakron grants the User a limited, revocable, non-exclusive right to use the Service for personal purposes. Access rights are tied to the selected licence tier (Free, Plus, Pro, Max) and its validity period.
The User agrees to:
Investment analyses and recommendations generated by the Service are computational and based on publicly available market data. They do not constitute investment advice within the meaning of applicable investment services legislation. The User makes investment decisions independently and at their own risk.
Fimakron aims to maintain the Service continuously but does not guarantee uninterrupted availability. Fimakron reserves the right to modify, suspend or discontinue the Service or any part of it without prior notice.
Paid licence tiers are charged according to the selected billing period. Subscriptions renew automatically unless cancelled before the end of the billing period. Cancellation does not entitle the User to a refund for an already paid period.
The Service and all its content — including texts, graphics, logos, software, calculation algorithms, database structures and user interface elements — are the property of Fimakron Oy and are protected by copyright, trademark law and other intellectual property laws.
The User has the right to use the Service solely for personal, non-commercial purposes. The User may not:
The right to use the Service does not imply any transfer of ownership. All intellectual property rights relating to the Service remain with Fimakron Oy.
Fimakron is not liable for indirect or consequential damages arising from use of the Service, including investment losses, lost profits or business interruption. Fimakron's total liability is limited to the licence fees paid by the User during the preceding 12 months.
These terms are governed by Finnish law. Disputes will first be resolved through negotiation. If no agreement is reached, disputes will be settled in the District Court of Western Uusimaa.
Fimakron reserves the right to amend these terms. Changes will be notified via the Service or by email. Continued use of the Service after a change constitutes acceptance of the new terms.
